In a major legal triumph, McCarthy Wilson attorneys have secured a pivotal victory before the Supreme Court of Maryland in a high-stakes business dispute involving a rapidly growing corporate franchise. Although the underlying dispute had been ongoing for many years, McCarthy Wilson first entered its appearance on behalf of its corporate client in order to obtain the Supreme Court of Maryland’s review and reversal of the prior unfavorable court rulings. The recent opinion was a complete victory for the client.

The firm’s efforts to obtain this outstanding result were led by Rick Evans and Amy Leete Leone, with key support from their litigation teams, including Jimmy Fegan, Paul Havenstein, and Kathleen Harris. Following extensive briefing and oral argument, the Supreme Court of Maryland unanimously ruled in favor of the client, holding that the lower courts had erred in both their valuation of damages and award of specific performance. Most critically, the Court reaffirmed that general damages must be calculated using fair market value at the time of breach – a standard that McCarthy Wilson correctly argued had not been followed in the lower court decisions. The decision is significant for Maryland contract law concerning investor rights, damages calculations, and specific performance as a remedy.
The opinion, issued July 1, 2025, is a clear reminder: when the future of your business is on the line, trust McCarthy Wilson. There is simply no substitute for seasoned trial and appellate lawyers with a track record of success.
