Clark, Jonathan R. and Cox, Jr., Ronald W., Maryland and Virginia Condominium Law: Handling Third-Party Liability Claims, Allstate Insurance Company, Summer CLE Seminar (August 26, 2009). In this seminar Jon and Ron presented the statutory provisions of both the Maryland and Virginia Condominium Acts and discussed the practical application in third-party liability claims. The seminar focused on the recent amendment to the Maryland statute that became effective June 1, 2009. Among other changes, the amendment mandates that after a casualty loss, the condominium association is required to repair and/or replace damage to the common elements and units, exclusive of improvements and betterments installed in units by unit owners other than the developer. Clark, Jonathan R., Subrogation Claims against a Tenant, Erie Insurance Group, Spring CLE Seminar (March 27, 2009). In this seminar Jon continued an ongoing series of subrogation seminars and discussed subrogation actions by a landlord’s insurance carrier against a tenant. The seminar focused on the principle of whether a tenant is deemed to be a co-insured of the landlord under the landlord’s insurance policy and whether the lease provisions permit such subrogation actions. The case precedent of Rausch v Allstate Ins. Co., 388 Md. 690, 882 A.2d 801 (2005) was analyzed in detail. Ryan, Thomas P., and Evans, Richard W., Update on First Party Lack of Good Faith Claims in Maryland, Utica National Insurance, Fall CLE Seminar (October 21, 2008). In this seminar, Tom and Rick continued the firm’s educational series on the recent and significant changes to Maryland insurance law dealing with the new “lack of good faith” statute in first-party insurance claims, using recent data and case study analysis since the enactment of the statute.
